Abstract

Dutch Abstract: De regering kent in haar Defensievisie 2035 de zwaardmachtfunctie aan ‘defen-sie’ toe. Bovendien voorziet zij twee rollen: first responder en last line of defence.
Na analyse van de constitutionele doelomschrijvingen en overige (formele) wet-geving blijkt dat de zwaardmachtfunctie aan de krijgsmacht toekomt. De krijgs-macht heeft tot doel (1) de handhaving van de onafhankelijkheid van het Ko-ninkrijk, (2) de verdediging van het Koninkrijk (en het bondgenootschappelijk grondgebied), (3) de handhaving en de bevordering van de internationale rechts-orde en stabiliteit, en (4) de bescherming van de andere belangen van het Ko-ninkrijk.
Daarbij kan zij drie rollen vervullen: first responder, safeguard en last line of defence.

English Abstract: While Article 97 the Constitution of the Netherlands has provided the purpose for the Armed Forces, the function, tasks and roles are designed based on national policy and will change over time. The most recent policy document ‘Defence Vision 2035’ has coined two new roles for Defence, the ‘first responder’ and the ‘last line of defence’. The authors assess whether these are new roles and if they apply to the Armed Forces or (the Ministry of) Defence as a whole, and if these new roles apply to all three core tasks - defending national and territory and that of our allies; enforcing the (inter)national rule of law; providing assistance during disasters and crises – or only apply to the latter as the Defence Vision suggests. Finally, the authors suggest to add a third role, to ‘safeguard’.
