The Forgotten Constitutional Identity of EU Competition Law Happy to share this piece co-written with Maciej Bernatt for Wolters Kluwer Competition Law Blog, analyzing the pro-democratic role of EU competition law and why a renewed view beyond the narrow economic confines of the current debates are needed. We argue for a constitutionally embedded approach that takes a critical view on the changing relationship between the state and markets, and take up the challenge of assessing the current “bounds” of both private and public economic power and what role EU competition law should play to prevent the abuse of such economic power, and protect civil and economic rights.
